The 2025 Fee Justification Studies and any related documents regarding the proposed adoption of the Level I School Fees will be available for public review, commencing Friday, April 11, 2025, during normal business hours at the School District's administrative office, located at 310 Nova Albion Way, San Rafael, California 94903.

Under the Mitigation Fee Act, a school district must establish a requisite nexus through a justification study that meets statutory criteria in order to collect school impact fees (aka developer fees) from residential and commercial/industrial development projects.
The Mitigation Fee Act requires public entities, including school districts, that collect developer fees to prepare a justification study or similar nexus report establishing that a reasonable relationship exists between residential/commercial/industrial construction and the need for public facilities to serve such development. San Rafael City Schools (“SRCS”) last prepared its residential and commercial/industrial justification studies for the Elementary School District (“ESD”) and for the High School District (“HSD”) in 2022. Current residential rates are $3.31 and $1.48 per square foot, respectively, for the ESD and HSD. Current commercial/industrial rates are $0.54 and $0.24 per square foot, respectively, for the ESD and HSD (except for commercial self-storage rates, which are $0.06 and $0.02 per square foot, respectively).
The State Allocation Board (SAB) adjusts the statutory residential and commercial/industrial fee rates per square foot every two years. The SAB last adjusted the statutory fee rates in January 2024, and are anticipated to do so again in January 2026. Current SAB rates are $5.17 per square foot for residential construction and $0.84 per square foot for commercial/industrial construction.
Public hearing concerning the District’s proposed 2025 Fee Justification Studies, dated March 31, 2025 (Fee Justification Studies) for the San Rafael City Elementary School District and the San Rafael City High School District; and consider adopting and approving the Fee Justification Studies for Residential, Commercial and Industrial Development Projects and Authorizing an Increase in Statutory Level 1 Developer Fees (Resolution No. 2425-63) presented to the Booard of Education on April 21, 2025.

2022 JUSTIFICATION REPORT
The District evaluates mitigation amounts periodically (approximately every two years). Mitigation amounts are determined based on studies that include demographic data, State Allocation Board information, and a statistical analysis of projected impacts of future development on the District.
If the addition is less than 500 square feet, no mitigation amounts are owed. If the addition is 500 square feet or more, mitigation amounts are owed for the entire addition. For example, if the addition is 750 square feet, mitigation amounts are owed on the full 750 square feet. If the square footage is 499 or less, no mitigation amounts are owed. If you are converting "unlivable" space (such as a garage or basement) into livable space that is more than 500 square feet, this qualifies for fees.
You must still complete an application with the District even when the addition is less than 500 square feet so the District can issue a certificate showing the addition is exempt. This includes ADUs and conversions of non-livable space such as but not limited to garages and basements.
Yes, mitigation amounts apply even if you have no children because there will be an impact on the District if you sell to someone with children.
